Activist Umar Khalid has decided to retract his bail plea from the Supreme Court, following a delay in another hearing regarding his bail application a week prior. Represented by senior lawyer Kapil Sibal, Khalid’s withdrawal was attributed to a “change in circumstances.”

The former Jawaharlal Nehru University student has been in jail for over three years, having been arrested in September 2020 on charges of criminal conspiracy linked to the Delhi riots and under the Unlawful Activities (Prevention) Act (UAPA).

Despite seeking bail from the Supreme Court on April 6, 2023, after previous denials by the Delhi High Court in October 2022 and a Karkardooma court in March 2022, his efforts have been unfruitful. Although Khalid was cleared in a stone pelting case in December 2022, he remained incarcerated due to the UAPA case.
Initially presented to the Supreme Court on May 18 of the previous year, his bail plea received a notice from a bench led by Justices AS Bopanna and Hima Kohli to the Delhi Police, but progress on the matter has been limited since then. Over the ten months since filing a special leave petition, his bail application faced fourteen postponements, with Khalid’s legal team requesting adjournments four times, some in agreement with the Delhi police.
The apex court accounted for at least six of these delays, with logistical issues causing two more, and an additional postponement requested by the Delhi police.
